GENERAL TERMS AND CONDITIONS OF TRAVEL AGENCY OPERATION

- SUBJECT OF THE TRAVEL CONTRACT
This Agreement defines the relationship between the tourist agency Mon Travel (hereinafter referred to as: the Agency) and the Traveler, or the travel contractor if the Agreement is concluded by a third party (hereinafter referred to as: the Traveler). The integral parts of the Agreement are these General Terms and Conditions and the Travel Program with relevant information and pre-contractual notices.
The contract comes into force when the Traveler and the Agency conclude it via the Internet, e-mail, telephone or other online channels, without the need for a physical signature. The Traveler is obliged to pay the entire amount of the arrangement or the agreed part and provide the remainder by the agreed deadline. If the payment is not made on time, it will be considered that he has canceled the reservation. The Traveler is responsible for the accuracy of the personal data and documentation provided.
- RESERVATIONS AND PAYMENT
When registering, the traveler pays an advance payment of 30% of the total price of the arrangement, unless the Travel Program stipulates otherwise. The remaining amount must be paid before the start of the trip or insured in another agreed way. If the Traveler does not make the payment within the stipulated period, it will be considered that he has given up without the right to refund the advance payment.
For "Last minute" offers, the full amount is paid immediately. In case of cancellation of the trip by the Traveler, the Agency reserves the right to retain the amount paid according to the cancellation conditions.
- HEALTH REGULATIONS
The traveler is obliged to inform the Agency about any health or dietary specifics that may affect the course of the trip.
- PRICES
Package prices are expressed in euros and are based on contracts with partners. They may differ from prices on site, and such differences cannot be objected to.
The Agency may increase prices up to 20 days before travel due to changes in exchange rates, tariffs or other unforeseen costs. If the increase exceeds 8%, the Traveler may terminate the Contract with a refund of the amount paid, provided that the Agency is notified within two business days.
- CANCELLATION AND CHANGES OF THE TRAVEL PROGRAM BY THE AGENCY
If the Agency significantly changes the program before the start of the trip, the Traveler has the right to accept the changes or cancel with a refund of the amount paid. If the changes occur during the trip, the Agency will compensate the difference in price or ensure the Traveler's return.
The agency may cancel the trip due to unforeseen circumstances:
20 days in advance for trips longer than six days,
7 days in advance for trips of two to six days,
48 hours in advance for trips shorter than two days.
If there are changes to the flight schedule, safety conditions or other circumstances, the Agency is not responsible for any additional costs.
- TRAVEL CANCELLATION BY THE PASSENGER
The traveler may cancel the trip in writing, with cancellation fees being charged according to the time remaining until the start of the trip:
Travel in Croatia:
45+ days before departure: 15% (min. €15),
44 – 30 days: 30%,
29 – 15 days: 50%,
14 – 8 days: 80%,
7 days or less: 100%.
Bus travel in Europe:
50+ days before departure: 15% (min. €30),
49 – 35 days: 30%,
34 – 20 days: 50%,
19 – 10 days: 80%,
9 days or less: 100%.
Air travel and cruises:
60+ days before departure: 15% (min. €50),
59 – 45 days: 30%,
44 – 30 days: 50%,
29 – 20 days: 80%,
19 days or less: 100%.
These fees also apply to changes of date or accommodation. If the Passenger finds a replacement, the Agency may charge administrative costs.
It is recommended to pay for an insurance policy in case of trip cancellation.
- PERSONAL DATA PROTECTION
The Agency undertakes to protect the personal data of the Traveler and to use it exclusively for the purposes of realizing the trip. The data is available only to employees who need it to perform their job. Customers have the option of choosing whether their data will be used for marketing purposes.
All payments are made in euros (EUR). Amounts on credit cards may differ due to currency conversion according to the exchange rate of the Croatian National Bank and credit card companies.
These General Terms and Conditions ensure transparency and security for all travelers when doing business with the Mon Travel Agency. For any additional information, Travelers can contact the Agency through its official contact channels.
Statement on the protection of personal data transfer
Protection of personal data in accordance with the General Data Protection Regulation of the European Parliament and of the Council No. 2016/679-Regulation and the implementation of the General Data Protection Regulation.
Monri WSPay, as an executor of credit card authorization and collection, handles personal data in its capacity as a processor and handles personal data in accordance with the General Data Protection Regulation of the European Parliament and the Council No. 2016/679 and according to the strict rules of the PCI DSS L1 regulation on data protection and data transfer. Monri WSPay uses an SSL certificate of 256-bit encryption and TLS 1.2 cryptographic protocol as the highest level of protection when registering and transferring data. Personal data used for the purpose of authorization and billing, i.e. in the performance of obligations from the Agreement or on the basis of the Agreement, are considered confidential data.

Monri WSPay does not process or use this personal data except for the purposes of executing the authorization and payment agreement. Monri WSPay guarantees the fulfillment of all conditions set forth in the applicable regulations on the protection of personal data for processors of personal data, and in particular the taking of all necessary technical, organizational and security measures, which is particularly confirmed by the PCI DSS L1 certificate.
PERSONAL DATA PROTECTION
The traveler voluntarily provides personal data that is used exclusively for the realization of the contracted trip. The agency guarantees data protection according to legal regulations and shares it only with partners necessary for the realization of the trip (eg accommodation, insurance, transport). The passenger agrees to the use of his data for further communication with the Agency.
The Agency applies appropriate data protection measures to prevent unauthorized access, loss or misuse.
COMPLAINT RESOLUTION
The traveler may submit a written complaint about a non-performed or incorrectly performed service within 8 days after the trip. It is recommended to address the complaint to the service provider on site and request a written confirmation. Group complaints are not acceptable.
The agency responds within 15 days, with the possibility of an extension for an additional 15 days. If the complaint is founded, the Traveler has the right to return the unused services, but not the entire arrangement. With "Last minute" offers, complaints about the quality of accommodation are not possible.
Until the Agency resolves the complaint, the Traveler may not involve third parties (e.g. court, media).

The agency acknowledges receipt and responds within 15 days.
The traveler may use alternative dispute resolution methods, including the Conciliation Center at the Croatian Chamber of Commerce or the European Platform for Online Dispute Resolution.

The agency offers additional travel insurance: health, cancellation, accident and luggage insurance.
LUGGAGE
Luggage transportation within the carrier's permitted weight is free of charge. Excess luggage is paid by the passenger. The agency is not responsible for lost or damaged luggage and recommends luggage insurance.
TRAVEL DOCUMENTS AND PASSENGER OBLIGATIONS
The traveler must have valid travel documents and comply with visa, border, customs and health regulations. The Agency is not responsible for the consequences of non-compliance with regulations.

FINAL PROVISIONS
By signing the contract, the Traveler confirms that he/she is familiar with and agrees to the terms and conditions. In the event of a dispute, the competent court is the one based at the Agency's headquarters, applying Croatian law.
PRE-CONTRACTUAL INFORMATION
Form with standard information for a package travel contract
This package-arrangement is subject to the provisions of Directive (EU) 2015/2302 and the Act on the provision of services in tourism (OG 130/17, 25/2019, 98/2019, 42/2020).
The Mon Travel travel agency is fully responsible for the proper execution of the package arrangement and provides a guarantee to cover traveler payments and repatriation in the event of insolvency.

Law on the Provision of Tourism Services
The most important passenger rights:
Travelers will receive all relevant information about the package before concluding a package travel contract.
There is always at least one trader who is responsible for the proper performance of all travel services covered by the contract.
Travelers are provided with an emergency telephone number or contact point information through which they can get in touch with the organizer or travel agency.
Passengers can transfer the package arrangement to another person with reasonable notice and possible payment of additional costs.
The price of a package may only be increased if specific costs (e.g. fuel costs) increase and if this is expressly provided for in the contract, and in any case no later than 20 days before the start of the package. If the price increase exceeds 8% of the package price, the traveller may terminate the contract. If the organiser reserves the right to increase the price, the traveller is entitled to a price reduction if the relevant costs decrease.
Travelers may terminate the contract without paying any termination fee and receive a full refund of all payments if any of the essential elements of the package other than the price are significantly changed.
If the trader responsible for the package cancels the package before the start of the package, travellers are entitled to a refund and, where appropriate, compensation.
Travelers may terminate the contract without paying any termination fee before the start of the package in the event of extraordinary circumstances, for example if there are serious security issues at the destination that could affect the package.
In addition, travelers may terminate the contract at any time before the start of the package by paying an appropriate and justifiable termination fee.
If, after the start of the package, significant elements of the package cannot be provided as agreed, alternative arrangements must be offered at no additional cost. If the services are not provided in accordance with the contract and this significantly affects the performance of the package, and the organiser fails to remedy the non-conformity, travellers may terminate the package travel contract without paying a termination fee.
Passengers have the right to a price reduction and/or compensation if the travel services are not performed or if they are performed improperly.
If a traveler finds himself in difficulty, the organizer must provide assistance.
If the organiser, or in some Member States the retailer, becomes insolvent, reimbursement shall be ensured. If the organiser or, where applicable, the retailer becomes insolvent after the start of the package and if transport is included in the package, repatriation of the traveller shall be ensured.
The organizer/seller, the Mon Travel Travel Agency, has contracted insolvency protection with Croatia osiguranje d.d.

PERSONAL DATA PROTECTION (GDPR)
The Mon Travel travel agency attaches great importance to the protection of personal data. All data is processed in accordance with the EU General Data Protection Regulation (GDPR) and other applicable regulations.
The collected data is used exclusively for the provision of contracted services.
Data is not forwarded to third parties except when necessary (accommodation, transportation, insurance).
Data transfer takes place via a secure server.
